Pension Act 44 Disclosures

Pennsylvania Act 44 of 2009

Introduction

Chapter 7-A of Act 44 of 2009 mandates the annual disclosure of certain information by every entity (hereinafter “Contractor”) which is party to a professional services contract with one of Penn Township’s pension funds. Penn Township has determined that the Act 44 disclosure requirements apply to Contractors who receive payment of any kind from a Penn Township pension fund. The disclosure form provides certain information in regard to any financial relationships that may exist between Contractors providing service to the pension funds and the elected and appointed officials of the municipality and whether such a relationship(s) could be a conflict of interest.

The Act requires that disclosure forms by posted on the municipality’s website and be filed and updated annually for the life of the contract between the municipality and each party.
